How Smarta Energy Limited uses cookies and similar technologies

Cookies Policy

1. Who we are

This Cookies Policy explains how Smarta Energy Limited (“Smarta Energy”, “we”, “us” or “our”) uses cookies and similar technologies on its website at www.smartaenergy.com and on associated digital services made available through that site.

Smarta Energy Limited is registered in England and Wales under company number 12403001. Its registered office is at Building 3, Workwell Office, Selby Road, Leeds, West Yorkshire, England, LS15 4LG. If you have any questions about this policy or our use of cookies, you may contact us at enquiries@smartaenergy.com or on 0330 0947 110.

2. What cookies and similar technologies are

Cookies are small text files placed on, or accessed from, your computer, mobile telephone, tablet or other device when you visit a website. Similar technologies may include local storage, pixels, tags, scripts, software development kits, log files and other tools which store information on, or gain access to information from, your device. In this policy, the term “cookies” is used as a convenient shorthand for cookies and comparable technologies unless the context requires otherwise.

3. How and why, we use cookies

We may use cookies for a range of operational and business purposes, including to: -

(a) enable the website to function properly and securely;

(b) remember choices or preferences you have made;

(c) maintain sessions and support navigation and form functionality;

(d) measure website usage and understand how visitors interact with content;

(e) improve website design, structure, content and performance;

(f) support the delivery of embedded content or third-party features; and

(g) where lawful, measure campaign effectiveness or support advertising and social media functionality.

4. Legal basis for the use of cookies and similar technologies

In the United Kingdom, the use of cookies and similar storage or access technologies is principally regulated by the Privacy and Electronic Communications (EC Directive) Regulations 2003 (“PECR”), alongside the UK General Data Protection Regulation and the Data Protection Act 2018 where personal data is involved. As a general rule, we must provide clear and comprehensive information about the use of such technologies. We must also obtain valid consent before placing or accessing non-essential cookies or similar technologies, unless a statutory exception applies. Where information obtained through cookies amounts to personal data, we must also identify an appropriate lawful basis under data-protection legislation for the related processing.

The Data (Use and Access) Act 2025 amended the legal framework relating to certain storage and access technologies. The current statutory exceptions are narrow and should be interpreted carefully. The fact that a technology has an analytical or functional element does not, of itself, remove the need for consent.

5. Statutory exceptions

Without obtaining prior consent, storage or access technologies may only be used where the legal requirements of an applicable exception are satisfied. The principal exceptions are as follows:

1. Communication: where storage or access is for the sole purpose of transmitting a communication over an electronic communications network

2. Strictly necessary: where storage or access is strictly necessary to provide an online service that the subscriber or user has expressly requested

3. Statistical purposes: where storage or access is for the sole purpose of collecting statistical information about use of the service with a view to improving it, and the relevant legal conditions are met

4. Appearance or preferences: where storage or access is for the sole purpose of improving or adapting the appearance or functionality of the service to the subscriber’s or user’s preferences, and the relevant legal conditions are met

5. Emergency assistance: where storage or access is for the sole purpose of identifying the location of a subscriber or user who requires emergency assistance

Where we rely on the statistical-purposes or appearance/preferences exceptions, we will only do so if the legal criteria are properly satisfied. In particular, those exceptions are not available merely because a tool is described by its provider as “analytics” or “functional”. Where the law requires it, we will also provide clear and comprehensive information and a simple means for you to object.

6. Categories of cookies we may use

(a) Strictly necessary cookies - These are cookies required for the operation, security and essential administration of the website, or which are otherwise necessary to provide an online service you have requested. They may include technologies used for load balancing, network management, session integrity, fraud prevention, form submission or consent preference recording.

(b) Preferences and functionality cookies - These technologies help the website remember settings or present content in a manner consistent with your choices, such as language, display or accessibility preferences. Depending on how they operate, these technologies may require consent unless a statutory exception applies.

(c) Analytics and performance cookies - These technologies help us understand how visitors use the website, which pages are visited, how users navigate the site, and whether errors or performance issues arise. They assist us in improving content, structure and technical performance. Unless a lawful exception applies in the specific circumstances, these technologies will only be used with your consent.

(d) Advertising, campaign and social-media cookies - These technologies may be used to measure marketing performance, support remarketing, enable social-media integrations, or help third parties present relevant content or advertising. Such technologies are non-essential and will only be used where we have a valid legal basis to do so, including consent where required by PECR.

(e) Embedded third-party content - If we use embedded media, maps, videos, social feeds, scheduling tools, document viewers or similar third-party services, those features may set or access cookies or comparable technologies. Where such content is non-essential, we will seek consent before enabling the relevant technology unless a lawful exception applies.

7. Current cookie information and preference tools

The technologies used on a live website may change from time to time as the site develops, is reconfigured, or uses additional integrations or service providers. Accordingly, any current cookie report, consent banner, cookie preference centre, or equivalent technology inventory made available on the website forms part of this policy insofar as it identifies the cookies and similar technologies then in use.

A current cookie report or preference centre, where made available on the website, forms part of this policy. Smarta Energy will seek to keep that information reasonably up to date so that it reflects the technologies actually deployed at the relevant time.

8. Consent and how to change your choices

Where consent is required, we will request it through an appropriate mechanism, such as a cookie banner or preference centre, before non-essential technologies are placed on or accessed from your device. Consent should be freely given, specific, informed and capable of being withdrawn.

You may withdraw or amend your cookie preferences at any time by using the relevant cookie settings or preference tool made available on the website, where present. Withdrawal of consent does not affect the lawfulness of processing carried out before consent was withdrawn.

9. Browser and device controls

Most internet browsers permit you to manage cookies through the browser settings. You may be able to delete existing cookies, block future cookies, or receive alerts before cookies are stored. Please note, however, that disabling all cookies or similar technologies may affect website functionality, security, availability or performance, and some parts of the site may not operate properly.

10. Personal data collected through cookies

Depending on the technology used, information gathered through cookies may include IP address, device identifiers, browser type, operating system, session identifiers, page interactions, page timings, referral information, approximate location, preference information and similar technical or usage data. Where such information identifies you, or can reasonably be linked to you, it constitutes personal data and will be handled in accordance with applicable data-protection law and our Privacy Policy.

11. Third-party technologies

The website may from time to time use third-party hosting, analytics, communications, embedded media, advertising, social-media or website-support services. Those service providers may place or access technologies through the website either on our behalf or, in some cases, for their own purposes as separate controllers. The identity and role of any such provider will depend on the live configuration of the website and services used at the relevant time.

Where third-party providers process personal data outside our instructions or under their own notices, their use of information will also be subject to their own terms and privacy information.

12. International transfers

Some providers of website and cookie-related services may process information outside the United Kingdom. Where personal data is transferred internationally, we will seek to ensure that a lawful transfer mechanism and appropriate safeguards are in place, such as adequacy regulations, contractual protections or another permitted safeguard under UK data-protection law.

13. Changes to this policy

We may update this policy from time to time to reflect changes in law, regulation, guidance, website functionality or the technologies we use. The most current version should be made available on the website, together with the date from which it takes effect.
